Medical records
Bupa Wellness would be the legal custodian of the OH records and the Data Protection Act 1998 would be complied with. Wherever third party medical reports are required, the Access to Medical Reports Act 1988 would be complied with. All Bupa Wellness staff are required to sign confidentiality agreements.
Information storage and control
Bupa Wellness has developed an in-house occupational health database in which all occupational health activity is recorded.
TUPE
As an experienced provider of services to corporate clients we have considerable expertise in the area of The Transfer of Undertakings (Protection of Employment) Regulations 2006, commonly known as TUPE.
We would normally discuss TUPE issues early on into the relationship with a new client as it is helpful to understand any likely TUPE obligations that may arise if we are successful in winning the business.
Following the successful award of the contract, Bupa Wellness would implement its strict Transfer of Medical Records procedure to obtain the records from the existing in-house occupational health team.
